In California, dram shop liability is limited compared to other states. Under California Civil Code § 1714, bars and restaurants are not typically liable for serving alcohol to an adult who later causes injury or death.

 

However, there are two key exceptions:

 

1. Serving Alcohol to Minors (Under 21)

An establishment that knowingly serves alcohol to a person under the legal drinking age can be held civilly liable if that minor later causes injury or death due to intoxication. This includes situations where the intoxicated minor injures themselves or others.

2. Serving a Visibly Intoxicated Minor
Liability also arises when a bar or restaurant serves alcohol to a minor who is already visibly intoxicated. This is treated as a serious breach of responsibility, and civil damages can be pursued by an injured party.
