The Hariri Law Group has filed several “parking ticket” class action complaints in Federal Courts in California. These class action lawsuits allege that certain cities in California, specifically, San Diego, Del Mar and Los Angeles (more cities may be included) have violated protected 4th Amendment rights when chalking or tagging vehicles of unconsenting vehicle owners who have parked their cars legally.

4th Amendment Protections

The first ten amendments to the United States Constitution guarantee such rights as the freedom of speech, worship and protections against unreasonable search and seizures.

 

The 4th Amendment provides:

 

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

Parking Ticket Class Action

A class action is a type of lawsuit in which a group of people collectively file a complaint. These types of lawsuits are filed against a defendant by one or more plaintiffs on behalf of the group who are “similarly situated” people with similar claims or injuries.

 

Class action litigation has been initiated in several cities across California, including San Diego, Del Mar and Los Angeles. The complaints filed on behalf of Plaintiffs and class members allege that cities across California have violated 4th Amendment rights. The complaints allege that parking enforcement officers use tools to mark, tag or chalk vehicles of unconsenting members of the community who have parked legally. The alleged illegal markings are then used to administer a government fine or sanction.

 

Parking ticket class action complaints will continue to be filed against cities who have, and continue to engage in alleged violations of the 4th amendment against members of the community.
