(<a href=\"https:\/\/www.latimes.com\/california\/story\/2022-09-19\/marijuana-law-california-employment-firing-hiring\" target=\"_blank\" rel=\"noopener\"><i>Los \u00c1ngeles Times<\/i><\/a>El estado de California reconoce el uso recreativo de la marihuana desde 2016. Sin embargo, hasta la aprobaci\u00f3n de esta reciente ley, los empleadores pod\u00edan despedir o suspender a sus empleados por consumir marihuana fuera del horario laboral.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d4b8f98 elementor-widget elementor-widget-heading\" data-id=\"d4b8f98\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Lo que protege la ley<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-855e08e elementor-widget elementor-widget-text-editor\" data-id=\"855e08e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La nueva ley denominada \u201cAB 2188\u201d proh\u00edbe a los empleadores discriminar a los trabajadores que consumen marihuana en su tiempo libre. La AB 2188 restringe a los empleadores la posibilidad de tomar decisiones de contrataci\u00f3n, despido u otras decisiones laborales basadas en pruebas de detecci\u00f3n de drogas que detecten cannabis o trazas de THC.<\/p><p>\u00a0<\/p><p>La justificaci\u00f3n detr\u00e1s de la nueva ley es que estas pruebas est\u00e1ndar de THC solo muestran si una persona ha consumido marihuana en alg\u00fan momento durante las dos semanas previas a la prueba. Las pruebas de drogas no pueden determinar ni demostrar que la funci\u00f3n cerebral del consumidor se viera afectada en el trabajo. Dado que el consumo de marihuana es legal en California, ser\u00eda injusto castigar a alguien \u00fanicamente por tener rastros de THC o cannabis en su organismo.<\/p><p>\u00a0<\/p><p>La nueva ley entrar\u00e1 en vigor el 1 de enero de 2024.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a6cab28 elementor-widget elementor-widget-heading\" data-id=\"a6cab28\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Lo que la ley no protege<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3d635d7c elementor-widget elementor-widget-text-editor\" data-id=\"3d635d7c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Seg\u00fan el LA Times, la ley seguir\u00e1 permitiendo a los empleadores realizar pruebas de detecci\u00f3n de otras drogas, siempre y cuando dichas pruebas no detecten \u201cmetabolitos de cannabis no psicoactivos\u201d. La nueva ley tambi\u00e9n excluye a las personas que trabajan en la construcci\u00f3n y a aquellas que solicitan o desempe\u00f1an puestos que requieren una autorizaci\u00f3n federal de antecedentes penales.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1b9927cf elementor-widget elementor-widget-heading\" data-id=\"1b9927cf\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">\u00bfQu\u00e9 sigue?<\/h5>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2a5bbb1d elementor-widget elementor-widget-text-editor\" data-id=\"2a5bbb1d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>El gobernador Newsom firm\u00f3 la nueva ley que protege el consumo de marihuana por parte de los trabajadores fuera del trabajo, junto con otros nueve cambios en la pol\u00edtica sobre el cannabis. Estas iniciativas surgen del objetivo de Newsom de crear \u201cuna industria del cannabis legal equitativa, segura y sostenible\u201d.\u201d<\/p><p>\u00a0<\/p><p>En cuanto a los empleados de California, a partir de 2024 ya no ser\u00e1n discriminados por el consumo legal de marihuana con fines recreativos fuera del horario laboral.
