Durante ese descanso, los trabajadores deben estar completamente \u201cfuera de servicio\u201d. Esta ley de California sobre descansos ha creado problemas en el sector a\u00e9reo. Las regulaciones federales exigen que los auxiliares de vuelo est\u00e9n preparados en todo momento para emergencias y permanezcan de servicio durante las fases del vuelo. Seg\u00fan la ley de California, los auxiliares de vuelo deben poder abandonar el avi\u00f3n para que se les considere fuera de servicio.<\/p><p>\u00a0<\/p><p>Una ley federal proh\u00edbe a los estados adoptar medidas que afecten a los precios, las rutas y los servicios ofrecidos por las aerol\u00edneas. Sin embargo, el Tribunal de Apelaciones del Noveno Circuito de San Francisco dictamin\u00f3 el a\u00f1o pasado que las leyes salariales estatales que se aplican a todos los trabajadores tambi\u00e9n deben cubrir a los empleados de las aerol\u00edneas. En el caso de San Francisco, varios auxiliares de vuelo de Virgin America demandaron a la aerol\u00ednea (ahora propiedad de Alaska Airlines) por incumplir las leyes laborales de California. El tribunal dictamin\u00f3 que la aerol\u00ednea deb\u00eda conceder a sus auxiliares de vuelo las pausas para comer y descansar exigidas por la legislaci\u00f3n de California.<\/p><p>\u00a0<\/p><p>En su petici\u00f3n, Alaska Airlines argument\u00f3 que la ley federal impone una norma uniforme a nivel nacional que deben seguir todas las aerol\u00edneas. Adem\u00e1s, en 2021, Airlines for America escribi\u00f3 al Tribunal Supremo en un escrito en el que afirmaba que imponer requisitos estatales al sector a\u00e9reo afectar\u00eda dr\u00e1sticamente a la industria.<\/p><p>\u00a0<\/p><p>El 30 de junio de 2022, la Suprema Corte de Justicia de los Estados Unidos rechaz\u00f3 los esfuerzos de Alaska Airlines por eludir la ley de descansos de California. Los magistrados se negaron a admitir a tr\u00e1mite el recurso de apelaci\u00f3n presentado por Alaska Airlines tras la sentencia de un tribunal inferior que obligaba a la compa\u00f1\u00eda a conceder a sus auxiliares de vuelo descansos para comer y descansar. La asociaci\u00f3n comercial Airlines in America ha afirmado que esta decisi\u00f3n provocar\u00e1 m\u00e1s cancelaciones de vuelos y un aumento en el precio de los boletos. En concreto, Alaska Airlines afirma que la sentencia obligar\u00e1 a la aerol\u00ednea a a\u00f1adir tripulaci\u00f3n adicional a muchos vuelos, cuando la empresa ya sufre una escasez de mano de obra.<\/p><p>\u00a0<\/p><p>Los auxiliares de vuelo que demandan a las aerol\u00edneas argumentan que estas pueden evitar f\u00e1cilmente los efectos de la sentencia simplemente a\u00f1adiendo un auxiliar de vuelo adicional a los vuelos m\u00e1s largos para que puedan turnarse en los descansos. Los auxiliares de vuelo y su sindicato estiman que esta soluci\u00f3n solo le costar\u00eda a la aerol\u00ednea $100 extra por vuelo.<\/p><p>\u00a0<\/p><p>Los auxiliares de vuelo recibieron $1,4 millones por sus reclamaciones de descansos.<\/p><p>\u00a0<\/p><p>La Suprema Corte de Justicia de los Estados Unidos tambi\u00e9n rechaz\u00f3 otro caso presentado por Airlines for America que cuestionaba la capacidad del estado de Washington para hacer cumplir las leyes laborales estatales contra las aerol\u00edneas.<\/p><p>\u00a0<\/p><p>Airlines for America ha declarado que \u201cla falta de una respuesta definitiva por parte del tribunal no resuelve el conflicto entre la legislaci\u00f3n estatal y la federal... y dar\u00e1 lugar a un mosaico de regulaciones estatales costosas y contradictorias, ya que al menos 19 estados tienen alg\u00fan tipo de legislaci\u00f3n sobre las pausas para comer y descansar\u201d.\u201d<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>California law requires that workers get a break at least every five hours.
