It cuts the costs and time of a trial and other various court or attorney fees. Even if the offer is not accepted by the other party, a court will see the attempt of making the offer as a good faith attempt in settling the case before trial. Courts always encourage parties to settle cases before trial.<br><br>\n\nA 998 offer also shifts one party\u2019s costs to the opposing party, it makes the opponent think about the true value of the case before going to trial. Costs that may be shifted to the opposing party in a 998 offer include:\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-783d6d15 class=\"fas fa-dot-circle\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">Must specifically name CCP section 998<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"fas fa-dot-circle\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">Must include a provision that allows the accepting party to indicate acceptance by signing a statement that the offer has been accepted<\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element
